HR Operational Support
- HR Professionals – The HR Service Center offers direct access to our team of SPHR/PHR-certified and experienced Human Resources professionals from 8:30 a.m. EST to 5:30 p.m. EST. Bi-lingual (Spanish) services are also available.
- Employment Relations (Client) – HCS assists managers/supervisors with day-to-day employment-related issues such as discipline, terminations, harassment, discrimination, wage payment and deductions. We can suggest possible courses of action and discuss applicable federal and state laws that may apply.
- Employment Issues (Worksite Employee) - HCS can act as a neutral party contact for worksite employees to discuss serious employment concerns like harassment, discrimination and more. We also conduct follow-up with the worksite employee as needed.

Organizational Development & Job Descriptions
- Staffing Analysis and Organizational Structure Assessment – HCS can review staffing, job titles and descriptions and make recommendations for alternative staffing levels, organizational design and structure, functional alignment, etc. to maximize staff effectiveness.
- Templates – HCS provides a job description worksheet that is compliant with the Americans with Disabilities Act (ADA).
- Customized – We provide samples of job descriptions to assist with development and implementation of compliant job descriptions for a variety of standard positions.
I-9 Compliance Assistance
- HCS maintains I-9 forms for worksite employees, provides reports detailing employees’ work authorization expiration/renewal dates and researches immigration laws.
New Hire Reporting
- Human Capital Strategies takes the hassle out of new hire reporting. Working under the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) of 1996, employers are required to report information on new hires to the appropriate state agency within 20 days of the date of hire. This affects employees who are hired, rehired or who return to work after a separation of employment. They accomplish this by reporting all new employees to the proper agency. (Individual states may differ in reporting requirements).
Social Security Number (SSN) Verification Report
- Commonly known as E-Verify – HCS reports new worksite employees’ Social Security numbers to the Department of Homeland for verification, informs clients of mismatched information and completes Social Security Administration wage verification requests.
The Arizona Legal Workers Act which went into effect January 1, 2008, was challenged in District court and many employers stood by to see the outcome. On February 7th, the ruling handed down by Judge Wake said that the Act does not violate employers’ due process rights or improperly infringe on the Federal government’s authority to regulate illegal immigration. What does this mean for employers? Arizona Employers must take immediate steps to ensure they are in compliance with the Act. If you have not already done so, Arizona employers must;
- Register for and use E-Verify, an Internet-based system that allows participating employers to electronically verify the employment eligibility of newly hired employees. As part of the registration process, employers must sign a Memorandum of Understanding with the DHS and SSA. By signing the MOU, an employer "agrees to allow" the DHS and SSA into the workplace to review E-Verify related records, including I-9 forms and reports generated during the verification process.
- Refrain from "knowingly" or "intentionally" employing undocumented workers. The Attorney General or County Attorney must investigate all complaints related to unauthorized workers. Depending on its determination, the court may temporarily suspend the employer’s Arizona business license, as follows:
- If the court concludes that the employer “knowingly” employed an undocumented worker, the court may order suspension of the employer’s business license for up to 10 business days and the court must place the employer on a 3-year probationary period.
- If the court concludes that the employer “intentionally” employed an undocumented worker, the court must order suspension of the employer’s business license for at least 10 business days. The court also must place the employer on a 5-year probationary period.
A second violation of this law committed during a period of probation, will result in a court order to the appropriate licensing agencies revoking all licenses that are held by the employer. Human Capital Strategies will continue to monitor this sensitive topic and keep you updated as additional legislation may take effect.

- Fundamental Employee Handbook - This provides federally-compliant policies (harassment, discipline, at-will employment, etc.) applicable in all states. It is included in employee new hire packets.
- Client-Customized Handbook - In addition to federally-compliant policies in the Fundamental Employee Handbook, HCS will collaborate with you on company specific and state policies.
Performance Management
- Performance Evaluations – HCS can develop customized performance management tools and training to support program implementation of position-specific evaluation forms, performance objectives, 360 degree feedback programs, etc.

Fair Labor Standards Act (FLSA) Review & Compliance
- FLSA Review & Compliance – HCS provides a format to assist in the review of job classifications, overtime requirements and exempt & non-exempt status as well as guidance for proper payroll setup.
Family Medical Leave Act (FMLA) Administration
- FMLA Processing and Administration – HCS will process and administer FMLA for eligible worksite employees, including assistance with determination of FMLA eligibility, providing letters, notices and reminders to worksite employees and tracking FMLA time used by the worksite employee.
